At Spectro Cloud, data privacy is important to us. This Spectro Cloud Privacy Policy (“Privacy Policy”) describes our personal information practices, including how we may collect, process, and disclose personal information from you or that you may provide on our website or through the online properties and products that we offer (collectively, the “Site” or “Sites”). Please take the time to read this Privacy Policy carefully in order to learn about your rights and choices regarding our processing of your personal information.
In this Privacy Policy, “Spectro Cloud,” “we,” “our,” and “us” each mean Spectro Cloud, Inc. and the applicable Spectro Cloud affiliate(s) involved in the processing activity. The addresses of our offices can be found at the end of this Privacy Policy. Any reference to “you” or “your” means the person or the entity using the Spectro Cloud Sites.

Directly from you- For example, you provide your contact and professional information to us when you sign up to learn more about Spectro Cloud’s products and services, download content, register for an event, and visit our offices.

Other Parties- For example, we may receive personal information from vendors who provide us with IT services, advertising services, or help facilitate our sales.

- Spectro Cloud does not use collected customer data to train or otherwise develop AI models.

Essential cookies. These are necessary for the Site and our services to work properly - for example, to keep you logged in or secure your session.

Cookies in our EU SaaS
For our EU SaaS offering, we do not use non-essential cookies or tracking technologies without your prior consent. Essential cookies required for this service to function are always active. Your organization can manage cookie preferences through the banner or settings available in the SaaS interface.
V. Spectro Cloud’s Security Posture & Measures Taken
Security is a critical priority for Spectro Cloud. We maintain a comprehensive information security program that contains industry-standard administrative, technical, and physical safeguards designed to prevent unauthorized access to personal information. However, no security system is perfect, and, due to the inherent nature of the Internet, we cannot guarantee that data, including personal information, is absolutely safe from intrusion or other unauthorized access by others. You are responsible for protecting your password(s) and maintaining the security of your devices and networks.
VI. Minors
Spectro Cloud’s Sites are not directed at minors under the age of 18 and those under 18 are not permitted to use the Sites. We do not knowingly collect personal information from minors. If we learn that we have collected the personal information of a minor, we will take steps to delete the information as soon as possible. If you are under the age of 18 you are not permitted to use Spectro Cloud Sites.
VII. How Long Does Spectro Cloud Keep Your Data?
We will retain your personal information for a period of time that is consistent with the original purpose of the data collection, or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We determine the appropriate retention period for personal information by considering the amount, nature and sensitivity of your personal information processed, the potential risk of harm from unauthorized use or disclosure of your personal information and whether we can achieve the purposes of the processing through other means, and on the basis of applicable legal requirements (such as applicable statutes of limitation).

In the above sections, we describe how we may collect, use and share your personal information for providing relevant content and advertising. Below, we describe how you may unsubscribe, opt-out, or otherwise modify settings related to our processing of your personal information.
Direct Email Marketing. If you wish to withdraw from direct email marketing communications from Spectro Cloud, you may click the “unsubscribe” button in our emails or contact us at privacy@spectrocloud.com. Please note, you cannot unsubscribe from critical transactional emails that are related to your provision of our online Service (such as those related to security and your Spectro Cloud account).
Direct Marketing – Phone or Postal Mailings. If you wish to withdraw from phone call or postal mail marketing communications from Spectro Cloud, please request to do so by contacting us at privacy@spectrocloud.com.
Analytics. We use cookies to manage and improve our Site and to collect aggregate information about Site usage by all of our users. If you browse our Sites or register or otherwise submit information to us, we collect the data that your browser transmits to our server. You can interact with our Cookie Banner to opt-out of non-essential cookies.
Your European Privacy Rights
European Union Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal information and on the free movement of such data (“GDPR”), requires us as the data controller of the Sites to provide additional and different information about our data processing practices to data subjects in the European Economic Area (“EEA”). If you are accessing our Sites from a member state of the EEA, the following additional policies apply to you.
Legal Basis of Processing. If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have a legal basis for doing so under applicable EU laws. This means we collect and use your personal information only where:

- We need to comply with a legal obligation.
Your personal information may be collected, transferred to, and stored by us in the United States, and by our affiliates and third parties that are based in other locations that are not subject to an adequacy decision by the European Commission or your local legislature and/or regulator, and that may not provide for the same level of data protection as your jurisdiction, such as the European Economic Area. We ensure that the recipient of your personal information offers an adequate level of data protection, for example, by entering into the appropriate back-to-back agreements and, if required, standard contractual clauses for the transfer of data as approved by the European Commission (as described in Article 46 of the GDPR). As a U.S.-based company, Spectro Cloud, Inc. is subject to U.S. laws and must comply with them. In these cases, we will ensure that your privacy and other fundamental interests do not override our legitimate interests.
EU SaaS Data and GDPR
If your organization uses our EU SaaS offering, we act as a data processor on your behalf. This means we process personal information only according to your instructions and in line with the terms of your organization’s Data Processing Agreement (DPA) with us.
We host EU SaaS customer data in the European Union. If data is accessed or processed outside the EU (for example, by support teams), we use Standard Contractual Clauses (SCCs) or other approved contractual obligations and safeguards to ensure your data remains protected.
EU AI Act
We are monitoring developments under the EU Artificial Intelligence Act and will update this policy if any of our AI-related practices fall within its scope.
Your California Privacy Rights
If and to the extent the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”), applies and you are a California resident, you have the right to understand and request that we disclose how we collect, use, disclose, and sell your personal information to the extent permitted by applicable law. Your India Privacy Rights
If you are located in India, we process your personal information in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”). This includes processing for lawful purposes such as providing services, improving functionality, and meeting legal obligations.
We may transfer your information outside India (e.g., to the U.S.), and we take appropriate steps to protect it. To exercise your rights or submit a grievance, contact us at privacy@spectrocloud.com.
Your Canada Privacy Rights
If you are located in Canada, we handle your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA). We collect, use, and share your data only for purposes a reasonable person would consider appropriate in the circumstances, and we’re committed to transparency and accountability in how we manage your information.
Automated Decision Making and Profiling
We don’t use automated systems to make decisions about you that have a legal or significant impact (e.g., denying access to services, employment, or affecting your rights) without human involvement. While we may use technology to help us analyze data, improve our products, or personalize your experience, people are always involved in any important decisions.

Depending where you are located, you may have certain legal rights regarding your personal information under the GDPR, CCPA, CPRA, DPDP, PIPEDA, or other applicable law or regulation.
